The Extreme Risk Protection Order Act (ERPOA) MCL 691.1801 et seq, went into effect on February 13, 2024. This act provides a process for certain individuals to request an order prohibiting an individual from possessing or purchasing firearms and ordering a surrender and/or seizer of a restrained individual’s firearm. ERPOA is commonly known as a “red flag law”.

Currently, to file a petition under ERPOA, one must do so in person in Room 928 of the Coleman A. Young Municipal Center, Two Woodward Avenue, Detroit, Michigan. Room 928 is open Monday through Friday from 8:00 a.m. to 4:00 p.m. but closed for lunch from 12:00 p.m. to 1:00 p.m.

Law Enforcement
All immediate emergency ERPO requests by law enforcement officers shall be made by calling Third Judicial Circuit’s emergency number at 313-967-2002. Judges from the Family Division will be assigned to ERPO cases including immediate emergency requests. Contact information will be provided to law enforcement.
