FAILED TO APPEAR JURORS

SHOW CAUSE HEARING  

 


 
 

Despite the attempts of the Court to make jury service as convenient as possible, the Court finds many jurors are just not compliant with the summons and the order to appear for service.  In 2014, the Third Judicial Circuit Court has called in and expected 86,863 jurors to report for jury service; 51% did not obey the summons and failed to appear. 

 

On March 20, 2015, the Court mailed out Orders to Show Cause to 272 jurors who failed to appear two or more times when summoned for jury service over the past 12 months.  From the number of letters originally mailed, there were eight jurors postponed and 40 jurors excused for a legal exception.  The number of jurors expected to appear at the Show Cause Hearing before Chief Judge Robert J. Colombo, Jr. on April 30, 2015 was 224 jurors.  One hundred and thirty jurors did appear before Judge Colombo and were given the opportunity to agree to a future date or to explain why they should not have to serve.  The majority of those in attendance chose to sign up for a future date. Bench warrants will be signed for those who didn't show up for the hearings and will face arrest.

 

The Court will continue to raise public awareness on the importance of jury service through future enforcement hearings.

 

 

Law Day

The Third Circuit Court and the Detroit Metropolitan Bar Association sponsored Law Day at the Court on Thursday, May 7, 2015.  Three hundred high school students from Detroit were able to hear an inspirational speech by Mayor Mike Duggan regarding following your dreams.  The students were then taken to 10 courtrooms in the Coleman A. Young Municipal Center where judges presided over mock appellant arguments relating to whether a school violated First Amendment rights by precluding wearing a t-shirt that said "I can't breathe."  The judges lectured and answered questions about the work done at the court and any related issues.

On Saturday, April 18, 2015, the Salvation Army William Booth Legal Aid Clinic and the Legal Aid and Defender Association, Inc., (LADA) conducted a child support help program at the main branch of the Detroit Public Library.

 

There was a brief information session relating to outreach programs to be held throughout the community in 2015, as well as an overview of our newly created Michigan Legal Self Help Center.  Participants were able to meet one-on-one with family law attorneys.  These volunteer attorneys assisted in completing motion packets and provided legal direction on child support, parenting time, and custody issues.   

 

Friend of the Court volunteers were on site to register participants on the MiChildSupport website and demonstrate how to check child support payments online.  

 

This program is one in a series of free child support help programs supported by various community service agencies including Wayne County Head Start, JVS Jewish Vocational Service, Detroit Head Start Fatherhood Initiative, Wayne County Friend of the Court, Abundant Children and Family Services Agency, Wayne County Mediation Center, Wayne County Community College, and Young Fathers Standing United.

May is National Mental Health Awareness Month and National Drug Court Month.  Chief Judge Robert J. Colombo, Jr., dedicates the May edition of the Third Circuit Court E-Newsletter to the Chief Pro Tem Hon. Timothy Kenny, the Adult Mental Health Court team, and the Drug Court team in the Criminal Division and Presiding Judge of the Juvenile Division, Hon. Virgil C. Smith, Jr. and the Juvenile Drug Court team. Also, Judge Colombo commends Judge Edward Joseph and court staff who envisioned the creation of the Wayne County Juvenile Mental Health Court and are working diligently to submit the grant funding application.  

 

These endeavors and works bring a much needed holistic, therapeutic jurisprudence approach to address mental health and substance abuse issues within the juvenile and criminal justice systems.

 

 

 

The Supervised Treatment for Alcohol and Narcotic Dependency (S.T.A.N.D.) Program is a juvenile drug court program that was designed to eliminate a juvenile's substance use and abuse and delinquent behavior.  The program utilizes a non-adversarial approach, therapeutic jurisprudence, and case management to develop, coordinate, and monitor the juvenile's treatment.  It forges partnerships with other public agencies and community based organizations to enhance the program's effectiveness.  The S.T.A.N.D. Program is supervised by Judge Karen Braxton. 

 

Participants in the S.T.A.N.D. Program are provided access to a continuum of alcohol and drug related treatment services.  The program also provides many other services such as family therapy, a parent group, tutoring, and mental health services.  While the program uses various sanctions for failure to comply with the terms of a juvenile's treatment plan, the Court focuses on incentives as rewards for the progress that a juvenile has made.  Additionally, the program promotes participation in a pro-social activity by hosting annual baseball games, basketball games, and bowling tournaments for the participant and their family and friends. 

 

The program lasts approximately one year but the actual length of the program depends upon the juvenile's progress.  In some circumstances, if the juvenile successfully completes the program, the original charge will be dismissed, allowing the juvenile to maintain a clean juvenile record.  After successful completion of the program, the participants are able to participate in a formal graduation ceremony at the MSU Detroit Center facility.  This ceremony allows the youth to share their successes with family, friends, and other participants still enrolled in the program. 

 

The S.T.A.N.D. Program is a very intense program; however, the benefits to the participants and their families are extraordinary.  Not only are the youth substance free after completion of the program, but they are well prepared for a productive life without any court involvement.  The S.T.A.N.D. Program has been very successful in the past and we look forward to changing the lives of many more youth in Wayne County.

Self-Help Center 

The Michigan Legal Help Self-Help Center of Wayne County helps residents of Detroit and Wayne County who are unable to afford an attorney.   The Self-Help Center is now located in Smart Detroit, Suite 1300 of the Penobscot Building at 645 Griswold in Detroit.  
 
The Self-Help Center is now open Monday through Thursday from 9:00a.m. to 4:00p.m.
