Instructions on Filing a Friend of the Court Referee Motion By Mail

A motion can be filed by mail; however, be advised that it may take up to 30 days for you to receive a hearing date in the mail. Motions being filed by mail must be mailed to:

DO NOT MAIL MOTION TO THE FRIEND OF THE COURT

Your motion must first be filed with the Wayne County Clerk before the Friend of the Court will schedule a hearing.

WHAT TO MAIL TO THE WAYNE COUNTY CLERK

  • The original, plus four copies of the motion and any additional sheets you have attached.
  • A copy of the current court order you wish to change; if applicable. Check the instructions attached to the motion to see if a copy of the court order is required for your motion.
  • The motion filing fee in the form of a money order, made out to the "Wayne County Clerk". The motion filing fee is indicated in the instructions attached to the motion. If you cannot afford the filing fee, you may submit an Affidavit and Order Suspension of Fee/Costs Form along with your motion. You must enclose copies of documents supporting your current income.
  • A self-stamped addressed envelope and a letter requesting a stamped copy of the motion be returned to you for your records.

Once filed, the Wayne County Clerk, will forward the motion to the Friend of the Court. If the motion has the required attachments, the FOC Scheduling Office will schedule the motion and mail out a notice providing the date and time of the hearing. If the motion does not have the required attachments or is incomplete, a hearing will not be scheduled and the motion will be returned to you.
