Important Updates

The Third Circuit Court Civil, Criminal and Family Divisions will be closed Tuesday, December 24, 2024 through Wednesday, January 1, 2025 in observance of Christmas Eve, Christmas Day, New Year’s Eve and New Year’s Day with the following exceptions for the Family Division – Domestic Relations Section:

  • On Thursday, December 26, 2024, Friday, December 27, 2024 and Monday, December 30, 2024, the Family Division - Domestic Relations Section will handle the following matters:
    • Petitions for personal protection orders;
    • Petitions for extreme risk protection orders
    • parental waivers; and
    • emergency family division matters.


  • The County Clerk’s office will be open to the public for in person Domestic filings on Thursday, December 26, 2024 and Monday, December 30, 2024. During this holiday closure, the electronic Domestic Case Filing System will be available on December 26-28, 2024 ONLY.
    • The County Clerk’s record room and personal protection order advocates in 928 CAYMC will be open December 26-30, 2024.
  • The Friend of the Court Scheduling Office will be closed for in person service during this time, but will have a drop box available for those wishing to drop motions off.
  • The Friend of the Court Call Center will be open and accept calls on December 26 and 30, 2024, 8:30 a.m. to 4:30 p.m. and December 27, 2024 from 8:30 a.m. to 12:00 p.m. The Call Center may be reached at 1-844-785-7593.
  • There will be NO William Booth Legal Aid Clinic on Thursday, December 26, 2024. The next Clinic will be Thursday, January 9, 2025.
Overview

Cases handled include divorce, paternity, personal protection, emancipation of minors, name changes, parental waivers, and infectious disease matters. Each of these case types may include matters concerning custody, support, parenting time, property, and other issues.

  • Please include your case number in the subject line of your email AND rename all attachments to accurately reflect what is being submitted (Example: “23-123456-DO DOE v DOE CJOD”).
  • All documents submitted to the Court must be emailed to the Court in PDF format. Screenshots will not be accepted.

  • All proposed order(s) must be emailed in PDF format to JudgeAbraham-Court@3rdcc.org.

  • Order(s) submission under the 7 Day Rule
    • Please ensure that the Proof of Service and a copy of the Order(s) are attached to the Notice of Presentment as one document and that each of the Order(s) are attached separately for entry in the same email.

  • Trials and Evidentiary Hearings
    • All exhibit and trial briefs must be submitted to the Court as hard copies no later than one week prior to your scheduled trial or evidentiary hearings. All exhibits must be tabbed, in a binder. Electronic copes of the exhibit and trial briefs must also be submitted to the Court at JudgeAbraham-Court@3rdcc.org no later than one week prior to your scheduled trial or evidentiary hearing.

  • Submission of Judgment of Divorce, Record of Divorce, Uniform Child Support Order, Uniform Spousal Support Order
    • complete in full, typed out
    • sign in wet ink; virtual/electronic signatures not accepted
    • the Court will accept virtual/electronic signatures if provided with authenticity certificate

  • All interpreter requests must be submitted to the Court at least 14 days prior to the scheduled Court hearing. Please submit the request to JudgeAbraham-Court@3rdcc.org with the case name, case number, party requesting the interpreter, and language requested. Failure to submit request will result in an adjournment.

  • Zoom Name Information:
    • Party: include First Name, Last Name, and Case number
    • Attorneys: include First Name, Last Name, P-number, and Client Name

  • Adjournments for Pre-Judgment Cases: Please submit a stipulated order to adjourn. Include the time standards on the case. 

  • Certified copies: Please contact the Record's Department for certified copies of the Name Change Orders and Judgment of Divorce.

Withdrawal of Counsel: The court will not enter an order of withdrawal, even if stipulated, without a properly filed motion and hearing.

Adjournments: Requests for adjournment will not be entertained via telephone. You must email the courtroom (JudgeMBKelly-Court@3rdcc.org).

Adjournments of Settlement Conferences and Case Management Conferences are subject to court approval: Submit a proposed stipulated order to adjourn via email to JudgeMBKelly-Court@3rdcc.org. Include the filing date of the case and whether or not there have been prior adjournments.

Pre-judgment cases will generally NOT be granted an adjournment, unless the parties have a scheduled mediation. A stip and order must be submitted to the Court via email. If you have any questions regarding an adjournment, please email the Courtroom.
